Srinagar, Dec 04: The Hon’ble Supreme Court of India may deliver its judgment in the prolonged case challenging the abrogation of Article 370 in December 2023.
Chief Justice DY Chandrachud, leading a five-judge Constitution Bench, presided over extensive arguments from both petitioners and the government during a sixteen-day session in August of this year.
After the exhaustive hearings, the Apex Court reserved judgment on September 5, 2023, marking a pivotal moment in the case. It’s noteworthy that the petitioners contested the J&K Reorganization Act, which resulted in the bifurcation of the State into Union Territories of J&K and Ladakh.
The impending retirement of Justice SK Kaul from the Supreme Court on December 25, 2023, and December 15, 2023, being the last working day before winter vacations, suggests an imminent release of the judgment.
The case, initiated on August 2, 2023, underwent comprehensive discussions and arguments spanning sixteen days. This significant legal matter, dormant for over three years, had its last listing in March 2020.
The petitioners challenged the constitutionality of both the abrogation of Article 370, which granted special status to the former state of Jammu and Kashmir, and the J&K Reorganization Act, asserting that these actions were unconstitutional.
